The federal government will go to the Supreme Court of Canada to appeal a court order to bring Omar Khadr home from a U.S. military prison, according to a CBC report.
Earlier this month, the Federal Court of Appeal upheld an ruling after a challenge by the government.
The federal government has consistently refused to ask that Mr. Khadr be returned to Canada from the U.S. prison in Guantanamo Bay.
The ruling states that Ottawa must seek to bring the 22-year-old prisoner back to Canada as soon as possible.
The Toronto-born Mr. Khadr has been held at Guantanamo for seven years.
He is accused of throwing a grenade that killed a U.S. soldier in Afghanistan.
