If the 99 Cent Only Store has higher prices, is that misleading?

The 99 Cents Only Store is facing two class action lawsuits as a result of raising its prices to $.99.99 on the most expensive items. US Currency does not allow fractional dollar values, so in essence, customers are paying $1 plus tax for certain items.

The company maintains that they advertised the price change, have signs at the stores, and have made an otherwise concerted effort to explain the price difference. At least one attorney, however, maintains that even such a minimal price difference is misleading to customers. A judge is currently deciding whether to allow the suits to proceed as class-action claims.
