Judge Questions Defendant’s Mental State in High Profile Child Abduction Case

A California judge has temporarily stopped criminal proceedings against Phillip Garrido. Garrido and his wife face a variety of charges related to kidnapping a child and raising her under captivity for almost two decades.

The judge based his decision on his own observations and a discussion with the defendant’s attorney. The judge noted the defendant’s behavior during proceedings was quite odd, including not listening to his lawyer and "frantically" writing notes when nothing of apparent importance was happening. 

Garrido’s attorney noted this is an issue about competency to stand trial and " . . . make a decision about his case."
