A New York judge has ruled that the estate of a woman can sue a 4 year old for negligence. The child is accused of running into the woman with her bike. The woman’s estate alleges she was seriously injured, had a hip fracture, and died 3 weeks after the surgery. At the time of the accident, the woman was 87 years old.
Although the court noted that children under the age of 4 are presumed incapable of negligence, the child was over the age of 4 at the time of the incident.
